Terms of service

1. What these terms cover

These terms form the contract between you and Quavern, SASU, 14 Rue de Menespey, 33185 Le Haillan, France, for the use of the myQuavern account space, the Marl assistant, the Marl API, the Marl Code application, the Quavsit transport data service, the Quavern MCP server, the Quavblok Minecraft network and the online services of the QuavernOS operating system, together with the Quavern websites, including the blog, oss.quavern.com and the status page.

Sections 10 and 11 add the terms specific to Quavsit, Quavern MCP and Quavblok; the rest of these terms applies to them as well.

Marl Code binaries come with their own licence file; it applies alongside these terms. QuavernOS is built on NetBSD and other open-source components: each keeps its own licence, and for the software itself the licences shipped with the system prevail. Enterprise customers with a signed agreement follow that agreement where it differs from this page.

This page is dated and versioned. If a change matters, subscribers are informed before it takes effect; continuing to use the services after that date means accepting the new version.

2. Your account

You need a myQuavern account to use Marl, to create Quavsit keys, departure boards or a feed watch, and to link a Minecraft account to Quavblok. The information you give must be accurate, and the credentials are yours to keep safe: actions taken with your account are treated as yours. One person, one account.

The services are intended for people aged 15 or over; under that age, a parent or guardian must agree. An organisation administrator manages the organisation's seats, tokens and access, and is responsible for who they admit.

A sign-up or a new device on a higher-risk network, and a sign-in on an account whose only second factor is the telephone, need a code sent by text message. Quavern pays to send it; your mobile operator may charge you to receive it, in particular while you are roaming.

3. Plans and prices

What each plan includes, and its price, is shown on the product pages and at checkout before you pay. Each service measures use in its own way, and the exact remaining amounts are always visible from your account:

• Marl: usage credits over rolling windows.
• Quavsit and Quavern MCP: units over each calendar month, in UTC. Only successful answers count units. The Free plan stops when its units are used up; pay-as-you-go bills every unit, monthly; on plans that include units, further units are billed at the rate shown in your account only if you turn overage on. The amount billed for units never exceeds the monthly spend cap shown in your account; once it is reached, requests are refused until the next month.

Quavern can change plans and prices for the future. A price change for an existing subscription is announced at least one month before it applies, and you can cancel before it does.

4. Payment, renewal and trials

Payment is handled by Stripe. Subscriptions are monthly or annual and renew automatically until cancelled. The subscription state recorded by the payment processor is authoritative.

Where a free trial is offered, its length is stated at checkout. A trial can be cancelled at any moment before it ends without being charged; otherwise the paid period starts when the trial ends. A given trial is available once per account.

Team plans require a minimum of five seats. Enterprise plans are set up by contract, without self-serve checkout.

5. Right of withdrawal (EU consumers)

If you subscribe as a consumer, you normally have 14 days to withdraw. The services are digital services that begin at once: by subscribing, you expressly ask for immediate performance and acknowledge that you lose the withdrawal right once the service has been fully performed, as article L221-28 of the French Consumer Code provides.

You can still cancel the subscription itself at any time for the next period, as described below.

6. Cancelling and ending the contract

You can cancel online at any time from your account — the billing page for Marl, the Quavsit page for Quavsit — in a few clicks and without calling anyone. Cancellation takes effect at the end of the period already paid; access continues until then.

Quavern can suspend or end an account for a serious breach of these terms, for unpaid amounts, or for abusive use, with notice proportionate to the situation except where urgency requires acting at once. You can export or delete your data from the account before closing it.

7. Acceptable use

Use the services lawfully and respectfully. In particular, do not:

• use them for illegal activity, or to create or spread content that harms others;
• try to bypass quotas, security measures or access controls;
• resell access, share paid credentials, or extract content in bulk by automated means outside the documented API;
• disrupt the service or other people's use of it.

Automated safeguards can block prohibited use. Every refusal carries a stable support code, and you can contest a decision by writing to hello@quavern.com.

8. Your content and Quavern's software

What you write and upload stays yours. You give Quavern only the licence needed to operate the service: storing your content, moving it through the systems that produce replies, and showing it back to you. Replies generated for you are yours to use, to the extent the law allows.

Quavern's software, names and designs remain Quavern's. Open-source components are governed by their own licences; Marl Code is proprietary and distributed as binaries.

Marl Code runs on your machine and reports nothing to Quavern unless you enable crash reporting yourself with marl telemetry on. When enabled, it sends the version, the operating system and the stack trace of a crash — never your prompts, your code or your file paths. You can turn it off again at any time with marl telemetry off.

Feedback you choose to send may be used to improve the services, without obligation or compensation.

9. AI answers

Marl generates answers with artificial intelligence. Answers can be incomplete or wrong, and they are not medical, legal or financial advice. Check anything important before acting on it, especially code you run and decisions that affect other people.

10. Quavsit and Quavern MCP

Quavsit gives access to public transport and shared mobility data through the api.quavern.net API, the quavsit.quavern.com application, departure boards and the feed watch. Quavern MCP, at mcp.quavern.ai, serves the same transport data to AI agents through the Model Context Protocol, with the same keys, units and limits.

Keys

Quavsit keys are created from your myQuavern account, up to the number your plan allows, and are personal to that account. Keep them secret: do not publish a key, including in code that runs in other people's browsers or devices. You can revoke a key at any time from your account.

Data, licences and accuracy

The data comes from the transport authorities, operators and public services that publish it, under their own licences: mostly the Licence Ouverte and the Open Database License, the Licence Mobilités for Île-de-France Mobilités, and each operator's own terms for free-floating bikes and scooters. Every answer names its sources in its attribution field. If you display or redistribute the data, keep that attribution and respect those licences, including the share-alike obligation of the Open Database License. The licences are listed network by network at quavsit.quavern.com/docs/data-licences.

Quavsit shows real-time information where the operator publishes it and timetables otherwise, and marks which is which. Published data can be late, incomplete or wrong, and a service can change without the data saying so. Quavern does not guarantee that a departure, a vehicle position, an alert or a journey is accurate or current, and Quavsit is not the official information service of any operator: check with the operator before relying on it for a journey that matters.

Maps in the quavsit.quavern.com application include Google Maps features and content, whose use is subject to the Google Maps End User Additional Terms of Service (maps.google.com/help/terms_maps) and the Google Privacy Policy (policies.google.com/privacy).

You may build applications and services on the data within its licences. Section 7 applies to Quavsit as to every service: in particular, access to the API itself may not be resold.

Departure boards

A departure board is shown to anyone who opens its link. Once a link is on a screen, treat it as public; if it spreads further than you want, issue a new link from myQuavern and the old one stops working. A board spends your Quavsit units when a screen displays it, within your plan, your overage setting and your spend cap; when they run out, the screen says the board is unavailable.

Feed watch

The feed watch, included in the Quavsit plans, alerts you by e-mail, by a signed request to a webhook address you control, or both, when the Quavsit Observatory's measurements change for a network you watch. The alerts report what one engine measured, not a finding by the operator; they can arrive late, or not at all when the measurements are unavailable. You are responsible for the endpoint that receives the webhook and for keeping its signing secret.

Quavern MCP

The MCP server offers read-only tools over the Quavsit data and counts the same units as the API; the feed-quality tool counts none. An AI agent that uses it acts on your behalf: you remain responsible for what it does with the answers, and the attribution and accuracy rules above apply to what it produces from them.

11. Quavblok

Quavblok is a Minecraft: Java Edition network at mc.quavern.net. Playing needs a Minecraft: Java Edition account, and Mojang's and Microsoft's terms apply to that account and to the game. Quavblok is not an official Minecraft service and is not approved by or associated with Mojang or Microsoft.

Linking is optional. Run /link in the game and enter the code at my.quavern.com/account/quavblok to link your Minecraft account to your myQuavern account; the game servers then read the player settings you save there. You can unlink at any time from the same page. Once your account is linked, /marl sends your message to Marl and counts against the Marl plan of the linked account; section 9 applies to its answers.

Section 7 applies in the game. Do not cheat, for example with software that changes how your player moves, and treat other players with respect in the chat.

To keep games fair, the game servers measure how players move. When a player's movement looks irregular several times in a row, a summary of the measurements is assessed automatically by an AI model. Everywhere except the survival world, a player that assessment judges, with high confidence, to be cheating is disconnected; a disconnection is not a ban. 12. Availability and support

Quavern aims for a reliable service but provides it as is, without a guaranteed availability level unless an Enterprise agreement states one. Planned maintenance is announced when it is likely to be noticed.

Support is provided by e-mail at hello@quavern.com, with priority handling for the plans that include it.

13. Liability

Nothing in these terms removes rights that the law gives consumers, or limits liability that cannot be limited, such as liability for gross negligence or wilful misconduct.

For business customers, Quavern's total liability for all claims in a contract year is capped at the amounts paid for the services during the twelve months before the event, and indirect damages, lost profits and lost data are excluded to the extent the law permits.

14. Personal data

How Quavern processes personal data is described in the Privacy policy, which is part of the information given to you under these terms.

Optional performance measurement exists only in the Quavern applications — chat.quavern.ai, my.quavern.com and quavsit.quavern.com. It is off unless you accept it, and refusing it changes nothing about the service you receive. You can give or withdraw that consent at any time from the privacy notice at the bottom of each application's pages.

15. Consumer mediation and disputes

If something goes wrong, write first to hello@quavern.com; most issues are resolved directly. If a written complaint does not resolve the issue, consumers can use a consumer mediator free of charge, under articles L612-1 and following of the French Consumer Code. The contact details of the mediator Quavern is appointing will be published on this page.

These terms are governed by French law. Disputes with business customers come before the courts of Bordeaux; consumers keep the jurisdiction rules the law gives them.

16. Miscellaneous

If one clause of these terms turns out to be invalid, the others keep their effect. Not enforcing a clause on one occasion does not waive it. Quavern may transfer the contract as part of a change in the company's structure; you are informed when that happens.

Notices are sent to the e-mail address of your account. The French version of this page prevails over the English one.
